you explain what you mean jce to our audience oh Thank you so much rest Justice is a very important Concept especially for communities that are coming out Conflict and Where there Have been so many narratives that uh fueled conflicts uh the Major Element of restorative Justice is restoring victims and of course re integrating uh offenders into the community as well but One Thing restorative Justice is not Is that uh It's Not helping um offenders to esap the criminal responsibility of their acts and it is not just a May restoration of victims but it has a
Dual Sword uh in both sides we have to restore uh victims and also reintegrate offenders into the community as well uh it has also an Element of Finding truth and reconciliation It's Not only about the victim and the offender It's en LGE about the community as well because in One Way or Another the community is also affected by this conflicts and it also helps in building democracy Peace In other important aspects also uh It's Not only an is in Africa or just in ethiopia but it has been Part of their jce System in different parts
of the world including the US England and Germany as well so it has been prac for a few for quite a few times few Years Now especially in Africa and South Africa Ruanda and now in ethiopia uh we just ratified um transitional Justice policy here in ethiopia in April of 2024 which has restorative Justice at its Heart uh It's really helpful to uh Build a resilient uh Peace and democratic System in ethiopia wow That's amazing so because you have tribot and the way that dial I think is Culture in ethiopia in Africa in a General
Way so I think you guys are set up to to dialog to look into eyes and to to stimulate a sincere conversation even though There is a problem or mistake involved right Yes that's true we have a depr Culture of oral conversations rather written cultures so we have different traditions Where community elders People Like elders and our community involving and kind of people personal Liv tove personal Conflict nationally speaking we have also elders elected elders to bring about communities and solve their conflicts and find the Truth and you know Fire up reconciliation as well but
incorporating customary dispute resolution mechanism into the formal criminal Justice System as a restorative Justice System involv several steps It's Not it can be done informally but It's also Good to incp into the formal criminal jce syst to bring about the best outcome yeah I would ask you about that because I know is your cal Heritage There is something natural for you guys but I assume you need to this in your traditional System with method with Science or something like that we need to be formal because we are justice and we need to be formal so
How difficult it is to incorporate restorative justice values and principles in your traditional System the traditional system has Own Way of working but it has also own limitations the formal syst Should Be In to Protect Children and women's rights because you know how it works with our cultures and Everything so It's good as I have mentioned earli It's good to incorporate both so that we would know the the scope of applications of the traditional system and it should also help the purposes of restorative Justice including restoration of the victim and of course for the offenders
to take resp as it shouldn't be you know covering the Truth or just Giving forgiveness for the offenders but it has to follow a certain procedure to bring about and secure and achieve the purpose of restorative Justice as well and the formal System should recognize and acknowledge the rle of traditional Systems of course and it has to incorpor it in the legal frameworks as i have mentioned the recent traditional Justice policy of It's ratified like less than a month ago it has a section on acknowledging the traditional means uh but it acknowledges also The Human
rights principles ethiopia has accepted so that Human rights are not violated and in the process of using traditional methods in Yes so restive justice and Human rights and rest Way of Culture of Peace all related all connected right and they need to be our traditional System because punishment cann be the only option of our Justice right so I would like to know because in Brazil rest Justice something in our traditional system is something New like maybe 20 Years Maximum so and then we we have more restorative Justice Project in in a Youth Law Field Now
We are trying to expand to criminal Law to family Law and also to domestic Violence which one is the hardest one So what Any Field that you guys jce with difficult Yes we have we Have been using traditional dispute resolution methods and rest Justice in different areas including the criminal Justice System as I have told you ear even in our transitional jce document policy we have clearly indicated its role in criminal issues uh resolving conflicts and Finding Out the Truth as well um and also in Family Matters we uh have provisions which um invite community
leaders to Help The Judge and the formal judicial System to solve family Matters and bring about the reports to the formal System and the juds are required to make sure that Children Women and other Human are not violated in the process of that but it has help to restore family Vales and Family relationships in our community and It's One of the things we are proud of it and we are expanding that into the conflicts that are happening in eia the like Years so also to resolve nares that inopia so I sure including this restorative Justice
Concept in traditional uh Conflict resolution methods Will bring about the intended purpose wow that's really Nice to hear and really inspiring For Us I'm sure All our audience is really inspired By Your Words and then our last reflection is about ch Justice in ethiopia just High I heard many benefit that you said previously but just to Highlight for them because the same question for all the guests so that's Nice to Thank you so much as I have there are two pillars of restorative Justice one is restoring the the victim and then reintegra the offenders striking
the balance between these two has been really difficult because both have their Own benefits and you know and making sure uh offenders also Take accountability One of the important benefits of restive Justice is promoting ability through using uh you know reconciliation and truth Finding as a Tool we have to promot accountability it's not like forgetting the offender and saying It's Okay you have done this you have brought about this Damage to the victims no it's not like that you have to acknowledge that victims Have been damaged through this uh but also uh We need to
promote accountability It has helped into promoting accountability and the other one is it really facilitates reconciliation because reconciliation is a long process it Should Be participatory as well both and uh in terms of the the victims and the community as well so it also facilitates recognition reconciliation it gives US you know the room and to bring about all the The concern Bodies into the platform and discus the issues the other One and the very important thing is it prevents um you know the reoccur of the conflicts and you know um change the narratives which are
the root causes of the problems the damages and the Conflict Once We have this restorative the Concept of restorative Justice reconciliation Peace building and participation will make sure that this conflicts this damages does not Happen All Over Again so It Will You Know It Will prevent but the problem Is that uh truth Finding is not an Easy Task you know people feel like the people involving in this Conflict feel like they have their Own truth from their Own perspectives so Finding The Truth is not an Easy Task That's why It's kind of a little bit
difficult to use restorative Justice as a min uh the other one is like people kind of equate restorative Justice with impunity and in complete Justice you know they feel like they they get away with whatever they are doing what they have done to the victims because One of the purposes of restorative Justice is uh re integrating the offenders into the community so um we should balance this All um concepts into restorative justice and also be careful of uh the concepts of and principles of Human rights as well that's Perfect It's really T to find bance
and to to the perfect measure to Vic and also to offender so I can imagine in even in Brazil it's not an Easy Task because in Brazil we are not built with that Culture of dial or Like That just like eop so Can you imagine how US recation in Brazil it is a big issue especially when we talk about domestic Violence and we talk about rest Justice domestic Violence many people think that reconciliation needs to be an outcome of restive Justice so We need to the victim and the offender hug each other Like That and
this is not the outcome so when we talk about reconciliation if it happens Perfect aming outcome but sometimes you can solve the Conflict they can understand what they did and the consequences but we don't need this reconciliation do Age that Oh yes as I have ear feel like When We Say restive Justice they equate it with a sense of impunity and for the offender to have a free pass to the victim It's Not like that we have to even we have to uh you know restore the victim compensate their damages and the offender should take
responsibility and accountability to what they have done not expect flower you know on their pedals It's Not How it works you know uh on the formal you know the the on a common Ground they Should have G through the criminal Justice System you know whereby they Should Be punished and go to the Prison and serve time but for the Sake of the the larger community and the purpose of Peace building we are Giving them a Gateway a lean way not because they Deserve it but for you know for a greater good and but in the
mean they they Should Be expected to compensate the victim and acknowledge what they have done to the victim and they should Take That on themselves as well I think that that what make difference because you are not only punishing It's Not only the estate or the Justice but the Person really understands What She or he did and of their beh in the vitim Liv and when they take an accountability of that sometimes it can be more it can be heavier then spend Some days in Prison I think because it's like a Prison in a remor
