Hey everybody welcome back to an all new episode of 10 to life with me Annie Elise now today's case is a little bit of a roller coaster and what makes today's case so interesting is that the case seemed to follow the normal stages of a murder investigation and a true crime case you have the murders the investigation the trial the conviction but when the person who had been convicted filed an appeal something they Said inspired the police to take a second look at their evidence and the information that they saw it changed everything that they

eyes with a shorter kind of like polished tight hairstyle now David had actually been married before Kim and he had a daughter from that marriage who didn't live with him and Kim after that previous marriage didn't work out he dated Kim for a few years and then they got married in 1989 together they had 7-year-old Brad and 5-year-old Jill who were just their pride and joy Brad and Jill literally Looked like miniature version of David and Kim as well now even though both David and Kim worked and had jobs Kim was the Children's Primary caretaker
that's just what seemed to work best for their relationship and as I said before the family lived in Georgetown Indiana a pretty small town with a population of less than 4,000 people it was a safe nice rural area with these top tier Public Schools a lot of parks and even though it was pretty small Georgetown Also had plenty of shops restaurants and other things to do so in other words it was the perfect place to raise a family and it was exactly where David and Kim wanted to be they had both grown up in the
area they had no intentions of leaving anytime soon so why not raise our own family here right now in fact ever since she was a little girl Kim had talked about being a mom and having a family and David really seemed to bring out the best in her so far as their Friends and family members were concerned I mean looking at their marriage from the outside it seemed like Kim was living the dream however their marriage did have its bumps in the road throughout the years and as it turned out behind the white picket fence
well things were pretty different back when Kim was pregnant with Jill in the summer of 1994 David ended up meeting a woman at the gym and he began having an affair With her the woman's name was Stephanie mccardy and David had actually known her since back in 1992 but she had a boyfriend for most of that time so for a couple of years they just remained friends but now he was seeing her often because she worked at the gym so when Stephanie her boyfriend broke up David was like now I'm going to make my move
and the two of them started hooking up they didn't really even try to hide it either which is what is so crazy because They would go out to clubs they'd go to dinner they'd go on all these other dates at all hours of the day it was almost like they didn't care who saw them together and what gossip would make its way back to his wife Kim it seemed like they just weren't concerned with it pretty ballsy but when Stephanie found out that Kim was pregnant she told David that she was done that apparently was
enough for her apparently it was one thing to break up a marriage but it was Different when a marriage had another baby on the way and then maybe the stakes are higher in her mind she said she didn't want to be involved with him any longer because of the guilt that she was feeling however that guilt apparently didn't last long for her because not long after ending things she got right back together with David so you're probably thinking where Kim was during all of this did she know well she definitely had a gut feeling that
Something was wrong so she asked David if he was cheating on her now mind you she was 5 months pregnant at the time and David who actually believe it or not had a reputation for being a pretty honest guy he didn't hold back he came clean and he said yeah I am cheating on you and not only that but I want out of this marriage altogether because now I have fallen in love with Stephanie now even though Kim had her suspicion that something was going on and that Something was wrong that didn't stop her from
being just in complete and total shock it sounds like she asked David if he was cheating mostly just to reassure herself and maybe give him a chance to deny it and make her feel extra loved but now instead here she was she was learning that her whole life was apparently a total lie she was 5 months pregnant her husband's cheating on her he wants out he's in love with the mistress like can you imagine how your Life would feel like it's crumbling down in that moment and I mean Not only was she already caring for
a toddler while she was pregnant but now to go and find out that her husband who up until that point she loved and trusted was cheating on her I can't even begin to imagine how hard that was for her so Kim decided to take baby Brad to her parents' place to figure out a game plan but then she realized that she hadn't done anything wrong so why should she be the one to Move out in all of this so she went back to her house and basically said to daveid like no you get out and
don't let the door hit you on the way out like I'm staying here so now David had to figure out where he was going to live but in the meantime he called his mom Sue to let her know what was going on and that he needed a place to stay until he could find you know a suitable apartment he knew he had to get out of this house ASAP and you know the saying A Mother's Love knows no bounds well apparently for Sue it did because she said no she did not support what he had
done to Kim she loved Kim like a daughter so no you're not allowed to move in with me while you just like crumble your life and cheat on your wife no way and that apparently pissed David off like no other he did not like being told no so while he was still on the phone with his mom he started like having a total meltdown Sue could hear him taking his anger out on The kitchen just wreaking havoc on the house like throwing things punching things so sue ended up calling one of his buddies from the
state troopers office to check on him the whole thing though was kept quiet due to the fact that David was still on the force at the time and they all figured that it was just best for that type of thing to not made public knowledge you know cops looking out for cops we love to see that right that sort of thing Allah Karen Reed now anyways when the mom was refusing to let him stay with her David ended up living with Stephanie the mistress in an apartment and Kim was left on her own to raise
Brad and just get through those remaining months of her pregnancy and then when she finally did give birth to baby Jill in February of 1995 David wasn't even there but his parents were which actually speaks volumes about the situation and how Great they are as humans but how awful he is so basically at this point everybody just thought that David was like a total and complete piece of right even his own parents which was a pretty fair way to describe him at that point that next month Stephanie the mistress apparently was having second thoughts about
being Allin with David though because it sounds like she wasn't totally over her ex now you'll remember David hit on her and made the moves on Her almost immediately after she and her ex broke up but now Stephanie was reaching out to her ex-boyfriend wanting to have a talk see where things stood test the waters in terms of seeing if they would ever get back together and as you can imagine David wasn't happy about that meeting and he felt like it went on way too far for way too long I guess he was the jealous
type but I've also got to imagine that he wasn't loving the fact that he just like blew up his Marriage for this woman and now she was kind of looking for a way out and might rekindle with her ex not to mention that if Stephanie did dump him he'd probably have to move again and get his own place this time and looks like the House of Cards was starting to fall for David which Good Karma right now he even went as far as to call Stephanie and demand that she come home while she was literally
sitting there still talking to her ex she listened to him but when she Got back David clearly wasn't in a good state of mind he ended up pulling out a small revolver out of his jacket and said he would take his own life because he was so freaked out by how long she had been gone and the possibility that she might get back together with her ex and leave him high and dry which I got to say like this is gaslighting and manipulation to a mother effing te to pull out a going be like because
of you because you took so long because I'm Scared that you're going to leave me for your ex so I'm going to take my own life like how manipulative are you that in my opinion is also definitely indicative of emotional abuse but I just I can't now Stephanie in all this was completely caught off guard she did her best though to calm David down and once he was back to you know a normal level she told him she was leaving the whole thing was just way too much for her which good for you because even
though I don't agree with You being a mistress you didn't need all of that mess now in spite of all those threats you probably know if you've ever dealt with a narcissist or a manipulator David didn't take his own life due to her leaving but instead just a few quick hours later he called Kim his wife saying he missed her he wanted to get back together big surprise right what convenient time in all of it like a little lost puppy just looking to fit in and find a home and while Kim she said Yes it
was actually a total in complete shock to everyone in her family too but she wanted to get back together with David I'm sure the fact that she was at home now raising a toddler and a newborn baby by herself played a major role in everything but either way the two of them got back together and they began putting together the pieces of their marriage Kim looked at this reconciliation as a good thing because her children now would be raised in a More traditional home a nuclear family and from there things seemed pretty good for them
for a little while but like the saying goes once a cheater always a cheater David was known to be a flirt but it didn't just stop with flirting he would find friends with benefits and he would use his patrol car as his hookup spot just really gross and grimy and he always seemed to have a woman on the side if one woman said no to him he'd get pissed off but he wouldn't stay long Mad because he would just go out and find somebody else who would say yes and this went on for years guys
not to mention his work life wasn't exactly going great either I mean come on it's not exactly professional to be using your squad car to pick up women and like hide your hookups from your wife it's gross and on top of that David and two other state troopers were involved in a lawsuit where they were accused of assaulting a 19-year-old during an Arrest he also had other complaints against him at worst but David didn't like the fact that he was demoted again talk about ego Maybe narcissistic Tendencies I don't know but because of this he
ended up putting in his notice and that's when he got set up with his uncle's Basement Waterproofing business in a sales position so even though he couldn't sleep with all of his other side pieces in his squad car anymore he did continue to cheat on Kim with Anybody that he could find including a random woman that he helped on the side of the road one night now his new job it came with perks better hours it let him spend more time at home with his family cuz his job as a state trooper and the fact
that he was a Serial cheater it kept him busy obviously he was never home with Kim or the kids and when he was he was just exhausted checked out run down but his new job made it so that he was around to help raise the kids and As a added bonus he made a lot more money than he had as a state trooper so the couple in some ways was doing well but of course Kim didn't really know what was going on so their picture perfect life was just very surface level now by the year
20 everything seemed good from the outside the kids were involved with a lot of activities at school Kim and David gave the appearance of being as good as ever and on Thursday September 28th 2000 Kim Took Brad to his swim lessons and Jill to her dance class that evening David was playing a game of basketball at a local church with some of his friends something that he liked to do during his time off he was going to be out late so it was up to Kim to spend the evening getting the kids home fed ready
for bed so when David got back that night it was around 9:30 p.m. and he was absolutely stunned at what he found when he entered his garage his whole family his entire Family had been slaughtered but he didn't call 911 instead he dialed the number for the station where he used to work police radio Patrice can I help you Patrice it's Dave cam let me talk to post Command right now okay he's on another line now let me talk to PO on Dave get everybody out here to my house now okay all right my wife
and my kids are dead get everybody out here from my house go to okay David we're get we got people on The way okay get everybody out here come here everything's going be okay all right we're going to get everything's not okay get everybody out here now they're coming go to Dave Cam's house now okay you know what happened David no they're dead I just got play B oh my God what I going do David they're on their way right now okay I got everybody coming listen I'm going let you talk to the tree ioss
the street I got to get Some help okay David you need do you need an ambulance get everybody out I'm going do you need an ambulance Dave he hung up the police rushed to this house as soon as they possibly could and when they got there David was just inconsolable blood was all over the floor of the garage and both Kim and Brad were lying on the ground Kim didn't have any pants on just her underwear and oddly enough her shoes were sitting on Top of her black Ford Bronco Jill was still in her car
seat and all three of them were dead from gunshot wounds David told the police what he had seen he said that when he got home from his basketball game as he was pulling into the driveway his headlights lit up the garage which showed Kim lying next to the passenger door of her car which was open there was blood oozing out of her head he said that once he saw Kim on the cement floor of the garage surrounded by Her own blood his mind instantly went to where are Brad and Jill so he looked inside the
car and he saw that Jill was still sitting in her car seat in the back and her long blonde hair looked as if it had been dyed red due to it being soaked in blood Brad on the other hand was lying over the back seat of the car on the driver's side because he had actually been shot as he was trying to escape as soon as David laid eyes on him he had this thought that there was still A chance that Brad might be alive so David put his hand on him and Brad's body was
warm which gave David hope so he dragged his son's body out of the car and he laid it down next to Kim he performed CPR which he was an expert in due to his time on the force but tragically he couldn't get Brad to wake up Kim and Jill were also dead at the scene now as for the rest of the house there were no signs of a Breakin gone bad and there weren't any obvious Suspects in terms of people who might want to murder Kim and her two precious innocent children in so the entire
thing just seemed really suspicious to the police that some random person would just come up their driveway shoot Kim Brad and Jill to death and then just leave without taking anything something was off Kim didn't have any enemies she was actually loved in the community and at her job so of course police looked into David first as they usually do in These types of situations and David said that he was at that basketball game all evening from 7:00 p.m. onward this was at the George town community church that was also the local church that he
and Kim attended on Sundays so police spoke with the men that David allegedly played with that night all 11 of them and they all said that they never saw David leave the church until they all went home together at the end of the night he only sat out one of the games but nobody Remembered him leaving during that time either in fact everyone agreed that he left a couple of minutes after 9:00 p.m. and he made that police call at 9:29 p.m. and the church was only an 8-minute drive from his home so there was
a bit of an opportunity there about 20 minutes where he could have committed the murders before he called for help it wasn't a huge window but it's not like it takes that long to shoot three people and that was suspicious enough for the Detectives to run some tests on the shirt that David was wearing on the night of the murders and it turned out the shirt had eight specks of blood that they matched to Jill's DNA and the police believed that the pattern of specks of blood was similar to what you would end up with
if you shot someone and some of their blood splashed back on you now as reminder David had an explanation for how some blood could have ended up on his shirt he said he Dragged Brad's body out of the car and tried to perform CPR but that just didn't match up with the pattern of Jill's blood that he had on him because he never even tried to say that he did CPR on Jill which I've got to say that was also pretty weird on David's part because even knowing he was a trained police officer and probably
knew how to tell dead people apart from injured people it was weird that he didn't even try to help his wife or daughter I mean He was a father he was a husband logic only goes so far when it's your own family covered in blood and you would think that you would have tried to help them somehow even if it was too late but maybe not now as far as the evidence from the crime scat went there was a bucket in the garage that smelled like bleach there were also unidentified fingerprints on the outside of
Kim's car but the detectives didn't think anything of them because she parked in a public Parking lot every day for work so they figured that the prints were from there on top of that the police saw a sweatshirt that was on the floor of the GR tucked under Brad's body when the police asked David whose sweatshirt it was he said he didn't recognize it as I mentioned before Kim wasn't wearing any pants when she was found she was only in her underwear and her shirt now even though the pants had been removed they were nearby
right beside her body and They were covered in blood now the really damning evidence came once the phone company eventually sent a bill that showed David making a call at 7:19 p.m. on the night of the murders and the phone call was made from his landline at the house which was a pretty big discrepancy given the fact that he had claimed that he had been playing basketball from 7 to9 I couldn't find who The call was to but the fact that it happened after 7:00 was very important And that wasn't the only piece of evidence
that came to light a little bit later the autopsy report showed that all three of the victims died from gunshot wounds but according to the medical examiner Jill had blunt forc trauma to her genitals and the trauma appeared to have happened within the same 24-hour period that her body was found in the car the medical examiner believed that that either it was from a straddle fall or an assault in a sexual way and a Straddle fall is what doctors call an injury to a child in the area between their legs like if they fell on
the top of a fence or hurt themselves on their bike seat something like that oddly enough Jill had been complaining about pain in her pelvic area for a while during her dance class she even cried about it now I don't know if this next detail has anything to do with the trauma that Joel had to that area but I do know that right before the murders Kim told a friend quote history is repeating itself but she did not elaborate now the friend told Kim that she should bring herself and the kids down to Florida to
visit her that they could talk more about whatever was going on Kim thought that it was a good idea to get out of Indiana but sadly she never got the chance so the question is was Kim referring to some sort of history of abuse or possibly something else maybe David cheating on her again Maybe he does have some sort of sex addiction and he would force himself on her because of that it was hard to say because at that point she never had the chance to go visit Florida and confide in her friend now something
else that stood out with the medical report was that Kim's feet had cuts and bruises on top of them that along with the fact that her shoes were off and just sitting on top of the car were just really difficult to explain the police couldn't Come up with a theory behind any of it it was still pretty early into the investigation but the people in David's life were already starting to have their doubts about him including Kim's mom Janice Janice knew that her granddaughter Jill was a sassy outgoing little girl and she believed that if
a stranger or someone that Jill wasn't close to had assaulted her she would have spoken up the only way that she wouldn't have said anything would have Been if it was David who did it to her so by that Sunday the rumor mill was churning especially because no arrest had been made yet but David went to church with his parents and his friends like he normally would On Any Sunday he felt it was best to be near his loved ones during such a nightmare in his life he also probably felt like the church was a
safe place for him because his uncle was the pastor Kim had actually been the treasurer and his grandfather Had built the church itself during the service David cried the entire time but then afterwards when he went outside a ton of reporters just surrounded him and apparently the news basically covered all of the facts in a way that made David look very very guilty apparently it was one of those situations where David didn't show any emotion it's something we see in these kinds of cases time after time too right the spouse and the parent who's supposed
to be grieving And all these things but by all appearances they're fine they're stone-faced and the public felt like David should have been crying while he was coming out of the church and he wasn't so because of that the general consensus was that he must have shot and killed his family the only real question in a lot of people's minds was about the motive there was no clear reason for him to do something so heinous so barbaric then later that afternoon David came Into the station to speak with the police and it got a bit
heated we've got some problems with things where they are and that's why you know brought inor we give you give you the opportunity Mor I cannot believe I cannot believe what do you mean can't believe what you are going to try to blame me for killing my children and my daughter tried to clean some of the blood or something like that no no no this is Ridiculous what about some bleach day no no no no no no no no the interrogation ended with David getting arrested the police felt like they had all they needed to
make the arrest and the blood spatter on the shirt was The Smoking Gun for them so after David's arrest that Sunday the funeral for Kim Brad and Jill was a few days later at midnight the coffins hadn't been taken away yet and nobody else was there so that was when the police let David go And pay his respects 15 officers brought him in handcuffs and gave him five minutes to say goodbye to his wife and two children and I feel like the only reason to be honest that this even happened was because he had worked
as a state trooper if he didn't have friends on the force I'm not so sure that this would have been allowed but I also feel like 15 officers is kind of Overkill but I don't know so now that an arrest had been made It was time to wait for the trial to begin and during this waiting period the small close-knit community of Georgetown really turned against David's surviving relatives many of whom lived in the town they would get ugly stairs anywhere that they went nasty messages on their answering machines they would have to give fake
names when making reservations and they were dubbed a pack of wolves the church that David's grandfather started was even shut down eventually Because there were just too many members who wanted nothing to do with the cam family so that was the overall Vibe when David's trial began in March of 2002 the prosecution's opening statement tried to answer the one question that everybody was still wondering about the motive they said that it had to do with all of David's Affairs basically wanted out of his marriage so instead of divorcing instead of separating he just decided to
wipe out his entire family and the Prosecutors bolstered this Theory by bringing out a dozen different women who David either had an affair with or approached about having an affair with all during the time that he was married to Kim and this went on for weeks so nobody could deny that David was a crappy husband who had cheated on his wife and the way he reacted to the murders didn't fit with what a lot of people expected for a grieving father and grieving husband which I've got to Say if I were a juror on that
jury I don't know that that would be enough for me to point to murder scumbag yes murder I don't know the only evidence they really had at this point was the blood spatter but and maybe I guess the phone call so is that enough I don't know now as for the actual jury when they came back with their verdict they found David guilty on three counts of murder one for each member of his family and one count of conspiracy to commit murder so he was Sentenced to a combined total of 195 years in prison so
you would think that that would be the end of that David was going to prison forever because Justice had been served not so much not so fast David filed an appeal and the gist of it is that the prosecutor should have never been able to talk about those Affairs that he had he thought that it made the jury biased against him and you might be thinking okay people don't love cheaters it's not a great look to keep Stepping out on your wife and then for her to turn up dead later but all of that evidence
also implicated him the phone call the blood on his sweater all those things well not exactly see during his trial David's defense team said that the blood stains on David's shirts didn't come from the gun's blowback but actually from Jill's hair they said that when David was getting Brad out of the car his shirt brushed over Jill's blood soaked hair which then left some spatter On his shirt A bloodstain analyst even came in to testify saying a gunshot will produce hundreds of stains coming back I've never seen and I believe the other experts for both
the prosecution and the defense have indicated that they've never seen just seven small or eight small stains from a gunshot I've never seen that so to try and support this Theory David's lawyers even brought these wigs to court for a demonstration the wigs had stage blood on them and They rubbed it against a shirt and sure enough they created a pattern that was very similar to what had shown up on David's shirt but there was still that one issue of the phone call the one that was made from David's home at a time when he
was supposed to be at this basketball game but the defense lawyers had an explanation for that too the phone bill showed that the call was made after 7:00 p.m. but it wasn't taking into account a 1H hour time difference Because Indiana's time zone is a little confusing most of the state is on Eastern time but 12 out of the 92 counties are in the central time zone so the call was actually made in the 6:00 hour meaning that David made that call before he even left for the basketball game and just like what happened when
the police first tried to verify David's Alibi the defense team was able to bring in all 11 of the guys who played with David that night and all of them said Yeah we never saw David leave the church never so needless to say the question of whether David was guilty was in a much grayer area now and after that appeal a judge ruled that they agreed with David the jury shouldn't have heard from all of those women that David had affairs with so on those grounds his conviction was overturned in August of 2004 but by
that November the murder charges were refiled against David meaning that he was going to be tried for a second time So David got to see the inside of a courtroom again on January 17th 2006 it had been almost a year and a half since he had learned that he would get another shot at a trial and during that time his defense team had been putting in all sorts of overtime hours trying to come up with a strategy that would really work for him a lot of it hinged around the sweatshirt I me mentioned earlier because
you'll remember it was found underneath Brad's body and David told The police he had never seen it before it didn't look like anything that had belonged to anyone in his family now at the time of the investigation nothing really happened with it but now the defense team knew that there was DNA on the sweatshirt and they wanted to run it through codus through the index system to see if it possibly matched another suspect the defense team at the time was saying that apparently the prosecution was unwilling to have the DNA run Through and it didn't
end up happening until a court order was put in place which I have to say it feels pretty confusing to me because in my mind there's only two possible outcomes here either the DNA comes back and it's either Davids or members of his family it makes their case Stronger by showing that there's no evidence that someone else was at the scene of the crime or the results show that there was somebody else there and it makes it more likely That David is more innocent if it's the first situation the prosecution should want the evidence that
helps them and if it's the latter you'd think that they want to avoid convicting an innocent man but for whatever reason they didn't want to see what the results were it could have been a budget thing the prosecutions swore up and down that the police had already done all the tests that they were able to do on the DNA at the scene of the crime they thought that These new tests that the defense team was asking for were just completely pointless and like I said they fought the tests until a court order went through allowing
it to go forward and here's the thing the system did detect DNA that hadn't been found earlier the prosecutors were wrong the police hadn't actually identified every single sample from the scene of the crime and the DNA that was on that sweater came from a man in his 30s named Charles Bon and it Turned out that Charles was a convicted felon who lived about 10 minutes away in New Albany he had been charged and convicted of multiple attacks on women over the years including attempted abduction using a gun armed robbery and the most interesting thing
about Charles is that he had sort of a bit of a thing with women's shoes and during these armed he would often take the women's shoes it was like a straightup fetish for him a trophy and it was actually a Fetish that he admitted to when he was arrested he would even go so far as to stalk different women and continuously call them asking them what type of shoes they were wearing and based on the comments he made he preferred high heels and if you remember when Kim was found dead her shoes were sitting on
top of the car which meant somebody took them off of her feet and put them up there so it really makes you wonder if he was involved that is what he possibly did to Kim especially being that her shoes were off and she had scratches on her feet I also wonder why he didn't take the shoes with him since he was known to do that before at the time of the murders Charles was out on parole so since his DNA was at this crime scene detectives brought him in for an interview and a polygraph test
he said that yes that sweatshirt had belonged to him once but that recently he had donated it he also said he didn't know David and wasn't Involved in the shootings well the results came back as deceptive basically the polygraph suggested that Charles was not being truthful specifically around the issues of whether Charles had shot someone in Indiana and what he was doing at the time of the murders so to recap Charles had failed a polygraph and the police had found his DNA at the scene of the crime frankly the police had more on him than
they had on David when they had decided to arrest him for the crime but For whatever reason the detectives didn't move on what they now knew they didn't make an arrest Charles was just free to go but the investigators did end up putting a tracking device on his car to keep tabs on him and the day after he was questioned he was tracked visiting the cemetery where Kim Brad and Jill were all buried when the police asked Charles about it he said that he was checking out the mausoleums for his family the detectives did confirm
that He spoke with someone who worked at the cemetery that day so you know it was possible but weird for sure now I guess it goes without saying but all of these new discoveries about Charles had the police rethinking their whole original Theory the one that pointed to David that David was responsible with the investigation reopened they reexamined Kim's car to see if there was any other evidence that maybe they had missed and as it turns out there was there was a Handprint found on the car a handprint that belonged to none other than Charles
so this was finally enough for the police to arrest and charge Charles but what they charged him with was conspir ing conspiring with David to commit the murders see Charles ended up giving a five-page written confession about how he knew David he said how David seemed like a really sincere guy to him and apparently they met at a pickup basketball game in New Albany and David Had talked a lot about church and Jesus and things like that he said that he ran into David a second time at a meat shop in New alony but this
time David wasn't talking about religion he was asking Charles if he could get him an un traceable gun David said he would pay him $250 for it so Charles agreed to the deal and he bought him a gun he delivered it to him and he must have put his hand on David's Bronco during the Delivery because that is why his palm print was there however a few days later Charles story changed again after he was questioned some more now he said that David was a pretty bad guy who often abused his daughter Jill in a
sexual way who cheated on Kim then just snap happed when Kim found out about everything that he was doing to his daughter Jill and that is why he wanted all of them dead to cover his secrets and this version of the story was pretty different from the One that he had told earlier now Charles said that before he gave David the gun he wrapped it up in his gray sweatshirt because it was leaking oil then he gave it to David who asked him to follow him in his car so Charles followed him all the way
to his house and then waited in the driveway he said that he could hear some type of heated argument going on but he didn't see anything then he heard somebody yell no and a gunshot went off then he said in a heartbreaking detail He heard Brad say Daddy Daddy calling out multiple times after that David came out pointing the gun toward him like he was going to kill him too so Charles said that he ran inside the garage to find some cover then David ran inside the house yelling you did this according to Charles while
he was in the garage he tripped over Kim's shoes so he put them on top of the car neatly which right like if you're running for your life from an armed gunman that's the perfect Moment to just tidy up and get rid of these tripping hazards make it make sense so after he moved the shoes he saw a woman pull into the driveway but he didn't know who she was and he didn't elaborate much on this part of the story he just said that he got out of there and he fled the scene Charles ended
his statement by saying my case is based on selling an illegal handgun to a person who used it to murder his family he said the reason that he didn't report the Murders right away was because he knew that his sweatshirt was there and he didn't want to get blamed plus Charles was black and David was white so he knew that nobody would believe that he was the innocent one in all of this he thought that everybody would pin it on him so Charles did change up his story over the course of a couple of different
interrogations but that was the final story and he was sticking to it that he didn't pull the trigger he only provided The gun that was used in the murders and that was enough for Charles to get sent back to jail to wait for his trial it came out that after Charles was arrested he spoke to a man named Stan Faith who was one of the prosecutors in David's first trial Stan had agreed to be his attorney but when Charles was questioned and asked for Stan to be there he then was told that it would be
a conflict of interest Charles then admitted that he talked to Stan before Ever even being considered as a suspect because he had known him for a while and was a friend of the family and when Stan was asked about the whole thing he just said I regret it I deeply regret it now in the meantime the police identified another bit of mystery DNA if you will that was found on the sweater it was from Charles's girlfriend Mala sing maddingly and by the time that the police sat down with Mala to interrogate her she wasn't with
Charles anymore in Fact she had ended things with him shortly after the time of the murders they had only started dating in July of 2000 so their relationship only lasted for about 3 months it wasn't some sort of serious thing she said that the evening of the murd Charles told her that he was going to work which was normal for him he usually had a night shift he left home around 6 PM pretty consistently but before he left he told Mala that he was going to meet a buddy After work Mala didn't think twice about
it because Charles was apparently always talking about his friends and hanging out with them so he left and she hung out for a bit and then she went to bed but around midnight Charles was home and he woke her up they started talking and Mala noticed that his knees were scraped now this part of the story kind of changes a bit depending on which statement Mala gave At first she said she didn't ever see Charles with a gun But then later on she said that that night he pulled out a gun and he showed it
to her she said she had never seen a gun before except on TV and Charles was really excited about it when he was showing it to her Mala didn't know what to think about all of this all she knew was that she didn't like it she wanted the gun out of her house so she told him to get rid of it then she went back to bed when she woke up in the morning Charles told her and his mom who lived There too to sit with him on the couch and watch the news and it
wasn't like the morning weather with the weatherman or the weather woman that's not what he wanted to watch he was watching coverage about the murders of Kim Brad and Jill and during the news Charles and his mom got into a very big fight but Mala didn't remember what it was about because they were fighting she excused herself from the room and she went and took a shower when she was done she Noticed that Charles and his mom were nowhere to be found so she had her friend come pick her up and drive her back home
after that she didn't see Charles for a couple of weeks but when she did see him again she ended things but if all of that was true why was mala's blood on the gray sweatshirt well she said that she was a diabetic who had to prick her finger daily to test her blood sugar so that was most likely why her blood was on the sweatshirt and I Guess she probably pricked her finger so often that she just didn't think twice about it so she likely picked it then went about her day hugging Charles folding laundry
Etc and there was some sort of transfer there either way I do think that it's interesting that Charles had a gun with him the morning after murders because remember in his story he gave the police he said that David was shooting at him and that he ran away from the crime scene it's not like he Went back later and asked for his gun back so MAA statement contradicted Charles's story in a major way and it made it look like David might be innocent because how else do you explain the gun getting from him back to
Charles but it doesn't sound like the police were thinking in those terms because they were still charging both men with the crime while Charles was in jail under the charge of C conspiracy he basically dug his own grave you could Say too because he ended up writing an autobiography called blackbone and in it he talked about selling the gun to David how he was there when the shootings happened like he was proud of it or something like an OJ Simpson Type move right like if I had done it Charles also wrote some love letters to
his fiance who was also shocker incarcerated at the time and in those letters he talked about how David was going to pay him with Kim's life insurance money that's Why he decided to buy him the gun in the first place it it was all about money things like that so Charles's trial began at the end of 2005 and between all of the evidence and the testimony from Mala plus all of those confessions that Charles put in writing he was found guilty of conspiracy to commit murder between all of the charges and the fact that he
was considered a habitual offender Charles received a sentence of 225 years in prison which means that all Of his sentences were lumped together so that they would all be run consecutively next up was David second trial and this one began on January 17th 2006 now you'll remember that the whole reason he got a retrial was because a judge thought that the prosecution had been in the wrong about talking about all of David's Affairs so now nobody was allowed to talk about the fact that David had been cheating on Kim just left and right and since
the prosecutors Couldn't present that as a motive they now said that he had been assaulting his daughter Jill in a sexual way for quite a while and to cover up what he was doing he shot all three of his family memb MERS to death however the defense team brought in a medical examiner who said that Joel's Heyman was still intact during her autopsy now of course that didn't necessarily prove anything there are a lot of different ways to harm somebody sexually and some of them Wouldn't cause the kind of damage that the medical examiner checked
for but the experts also testified that Jill had many blunt force injuries all over her body yes some were in the pelvic region but that wasn't alone enough proof that Jill had been targeted in in that way in fact this expert said that the prosecutors were totally misrepresenting the evidence twisting it to make things sound way worse than they actually were basically this witness didn't think that There was any reason to believe that Jill had been harmed in a sexual manner besides that a lot of new information was brought up in this trial I mean
after all by tracking Charles down the police had made a ton of new discoveries a lot of them came from Charles himself and from Mala so there was plenty of testimony showing that David had bought the gun so that he could shoot his family well at the beginning of March of 2006 David was ultimately convicted a Second time for the murders and this time he was sentenced to life in prison without parole so finally that was that right or no not so much this time around David once again appealed all because of the allegations that
he had abused his daughter Jill you have to remember that he has been in prison this whole time but all along he argued that there was no evidence that this abuse ever happened and the fact that the prosecution had thrown those accusations Around had in his words had turned the jury against him and believe it or not the Indiana Supreme Court agreed to overturn the decision saying missing from this record is any competent evidence that the defendant hurt this child in a sexual way which can you even begin to imagine what Kim's family was going
through during all of this having to relive their daughter and grandchildren's death during another trial over and over and over again k Kim's dad Frank said I was kind of surprised by the overturn of the last verdict all we want is the truth and the truth is Dave's guilty that's all we can ask for Kim's family really wanted David behind bars for life I mean they were sick of all of the back and forth so David's third trial began in August of 2013 nearly 13 years after the murders this time around the prosecution was trying
to argue that David's motivation for the murders was the life insurance Policy after all that's what Charles had told the police that David wanted the money and Charles was getting a cut of it too and interestingly enough Kim's life insurance policy had recently been increased right before her death however she had signed off on it meaning she knew about this change she had approved the change Charles actually ended up testifying in this third trial saying that David had tricked him into being at the house when he shot his family and Also said that he almost
shot him to death before Charles escaped like we talked about earlier he also said that he never touched Kim Jill or Brad it was all David who did the actual killing however David's lawyers had even more DNA evidence to introduce they showed that Charles's DNA was on Kim's Underwear and it was also on Jill and Kim's clothing his DNA was also found under Kim's nail which proved that she had put up a bit of a fight before her Death so really the only real evidence placing David at the scene of this crime was the blood
spatter on his shirt which like we covered before could easily be explained away from the fact that David probably brushed up against Jill's head and her hair when he tried to save Brad so after weeks and weeks of evidence on October 24th 2013 David was found not guilty on all the charges there just wasn't enough evidence to prove his guilt and there Was an enormous amount of evidence that Charles probably did it so David was acquitted and when the news was read he broke down in tears thanking his team thanking the jury just overcome by
emotion now obviously not everyone was as thrilled and the community was actually pretty divided over the outcome 13 years is a long time especially with a lot of the media coverage and not everyone was convinced that David was innocent just because he had been Acquitted so David ended up staying in the same town rather than go somewhere new to start fresh and he went to work again at his uncle's business and started rebuilding his life and recently he filed a civil suit against some of the people from the prosecution team you can't wreck someone's life
um take away their freedom their Liberties their reputation their identity their Hometown um you're not supposed to be able to do that in this country and um To have that done to me by people that I knew and that I cared for uh and worked with um you know the outrage was there it was refreshing to uh hear their remarks not just hear the remarks but the manner in which they made the remarks and um it was very obvious to tell u based upon uh their interaction with specifically the Attorney General's office that uh they
saw it for what it was um in fact being humorous at one point he ended up getting over $5 Million from the settlement he used some of the funds to pay back his friends and family members who had helped support him in the fight for justice over the course of those long 13 years and today David seems to be living his life having quite the support system around him he's rebuilt his life from the ground up he lost 13 years of his life his reputation and most importantly his wife and children since 2013 David has
kept in touch with the jury members who brought Him to Freedom he was also hired by investigating innocence as a case coordinator which seems like a perfect fit given his story investigating innocence is a nonprofit wrongful conviction advocacy organization that provides criminal defense investigations for inmates in the US now I wish that I could give you a reason for why Charles did what he did and how it all went down but Charles to this day continues to say that he's innocent he also says that he Has founded Jesus and he is now a devout Christian
in a more recent interview he talked about his version of what happened on the night of the murder we're clearly both there and one of us is the killer David cam is the killer Bonet starts out by telling us why he says he initially lied to investigators I didn't tell the truth about everything because I wanted to stay completely out of the mix I didn't want to go back to prison as I told them the truths about The story they didn't believe it so then I started just telling them things that I thought that they
could believe at the end of the day I've told I think altogether like five different versions so tell us now what is the truth what is the truth on September 28th I took a second untraced weapon to the cam residents David cam showed up we were talking outside of his house his wife Kim Cam and the two children Brad and Jill pulled up in a um I believe it was A black Bronco as the um a garage door lifted up she drove in I seen her brake lights come on and then he went into the
garage and then I heard arguing and I heard um a no and then I heard a daddy no and then I heard pop pop pop my sweatshirt was knock tucked under his son he staged that Kim cam his wife was not uh undressed at all I learned from television and in my discovery that someone had removed her pants it's Pretty shocking that David got convicted twice with all of that exonerating evidence I have to say although a lot of people still think that he played a role in this and I am interested to know what
you guys think but remember he had the 11 Witnesses who said that he was at the game the DNA that shows that Charles did it and every step of the way I thought oh come on this is obvious but I don't know there's still a lot of people on the fence and I again I'm just I want to Know what you guys think Kim's family still feels that David is guilty and they are not changing their minds after the jury finally found him not guilty Kim's mother Janice said I had already turned it over to
God David has made it clear to the media that he would love the chance to make things right with Kim's family but her father Frank responded that's not going to happen he's not fooling anybody I don't think now many people in the community still Support Kim's parents and will even go up to them in stores and in public and offer support which makes me wonder if people ever give David a hard time since he still lives in that same town where it all happened now whatever you think about this case it does shed some light
on a big issue here research suggests that 4 to 6% of inmates in American prisons are actually not guilty which is crazy to think about and really just goes to show how important organizations Like the Innocence Project really are they work to free people like David and hopefully prevent situations like his from happening in the first place but I'm curious where you guys stand on all of this if you think that David is innocent how and why do you think that Charles committed the murders because David said he never met Charles before so did Charles
just randomly see Kim and the kids out and about and then stalk them them follow them home and then Attack and murder them I'm also curious what Kim meant by when she said history was repeating itself I wonder if she knew that David was cheating on her again that seems like the most obvious explanation to me there are definitely still some unanswered questions on this one but if you believe that David is innocent you should be glad that he has found some peace and is free today yes he cheated on Kim but let's face it
