Now, the law was passed mainly to ban gambling houses so that people won't play gambling in public places and gambling houses. In Section 13 of this Act, they banned the gambling done on animal fighting and at that particular time, there was no Internet so, these online games, fantasy games nothing was mentioned about them in this particular act. In Section 12 & 18 of this Act, it was mentioned that gambling is an illegal activity in India but if anyone plays any skill based game, then it can be played.
Its entirely legal. Means game of chance is illegal & game of skill is illegal but it wasn't defined in this act that what would be the game of skill and what would be game of chance & all the things that weren't defined puts everything in trouble when cases go in court. Now, this act was implemented in the entire British India but horse races, lotteriees were hosted parallely, they weren't restricted that much.
The main problem if this act to solve was that moeny shouldn't be gambled on animal fighting, gambling hiuses should be closed. Now, in year 1947 we get independent & after which, when the constitution was being prepared then the Public Gambling Act, 1867 was adopted as it it without any change but we did one thing, this act was categorized in state list of Seventh Schedule means if the state wants, it can follow as it is or if the state wants, it can change it and make a new law of its own. So, states like Bihar Chhattisgarh, Chandigarh, MP, Manipur & many other states followed as it is in their state.
On the other hand, Andhra Pradesh, Assam, goa, Gujarat, Maharashtra, Kerala these states amended this law & then implemented in their state. Now, from here the real struggle starts day by day things got modern but the law, was old that's why even after the law, problem wasn't solved. And at that time, case by case - as the case was filed in court & on that basis the solution was found.

Chamarbaugwala filed a case that this competition isn't illegal but entire legal under Public Gambling Act, 1867 because this is a game of skill. And, game of skill in India is legal and after multiple discussions in court it was proved that Chamarbaugwala was hosting game of skill and not game of chance. Now this case, is termed important in the history of India because the law of India didn't define the game of skill & game of chance, only the name was written.
The judgement given by Supreme court of India, gave clarity to people what game of skill is - be it any sport somewhere or the other, it has luck or chance but the court says that - the dominating factor in it should be skill and not luck, if skill is dominating that game then its a game of skill and not gambling but if luck is only dominating the game alone then its game of chance. In game of skill consists of mental ability, physical ability, strategy by practicing one can improve their skill like Chess. Whereas, in the game of chance, the major factor is luck, random factor, on which nobody has any control.
How hard you try, you won't be able to do anything all the things depend on luck like slot machine. So, the act in which game of skill & game of chance was mentioned after this case, a clarity was there, if any case goes in the court regarding gambling or betting money on sports then case by case it was checked if it was a game of skill or game of chance. Police takes action on that basis. Now suppose, there's such a game which doesn't have guidelines nobody filed a case in court then it continues in the society. Now, the guidelines are that gambling in public place is illegal, so people who play cards in public are arrested by police but this year there was such a case that they arrested in case of Ludo as well.
A man in Ahmedabad, at Manav Mandir bus stand was gambling by betting Rs 8000 on Ludo. So, the police even arrested him. You might've seen that many people during summers out of the house or on the road play Ludo or cards and bet money on them for fun.
So, technically that is also illegal because ultimately betting money and playing in public is Gambling. So, slowly rules were made in India on the basis of the cases that were lodged in court. Now, comes the year 1968 and a man named K.
Satyanarayana was running a rummy club and police raids there that gambling was being played here, though K. Satyanarayana was trying to explain the police that its a game of skill. The police doesn't agree & this entire case goes into court that is Rummy a game of chance or game of skill.
In this court said that, to play rummy you need to remember cards, one has to decide when to throe which card its not just a game of chance, it also requires skill. And K. Satyanarayana wins this case and from year 1968, Rummy game becomes legal in India.
Now, some people would say that Rummy game isn't legal all over India, there're some states where its not legal, Andhra Pradesh, Assam, Sikkim, Nagaland, Meghalaya, Telangana. These are states where paying rummy game is banned because these states have changed rules & made separate ones. Whenever a game is mentioned in India, then first you need to see which state is that game played in, so until year 1968 this goes on, after few years talks start regarding Casino as well that is it legal or illegal.
So, Daman and Diu Public Gambling Act, 1976 is introduced which isn't for all over India but only implemented on Goa, Sikkim and Daman. After this Act, Goa, Sikkim and Daman allowed casinos and slot machines that is why in today's date, you can go in these states you can use casino and slot machines and gamble but not in other places. While this act was implemented in these states, it was said that they have more international tourism, many tourists visit that is why it was implemented.
But one cannot start any random way, you need to take a proper license. So, total of 200 slot machines were allowed in Goa and that too in 5 star hotels and on one license you can get 20 slot machines this was decided and in future, it was increased to 400. Now after that, horse racing was also going on in India.

Lakshmanan in 1996 filed a case that horse racing is a game of skill, it isn't a game of chance or gambling. And as soon as, it'll be proved as a game of skill then it can be played then it comes out of the category of gambling so, case of horse racing was also discussed about.
The man comes and bets money on race courts doesn't bets on chance, he's looking at the performance history of the horse, what is the condition of track, skills of jockey - he bets after looking at many things, so its a game of skill. So, horse racing was also put in the category of game of skill and K. R.
Lakhsmanan wins this case & from then on, year 1996 betting in horse racing was legal in India. So, you can think that, if horses are running on a track then betting on it is a game of skill and on the same track if cricket match is being played & if money is bet there then its gambling, police will arrest you. Now, after this lottery was hosted side by side in India So, as 1998 comes there were many cases on it.
There were many private players started doing fraud in it and ran away with people's money & lot of cases were being filed. Huge loss was being done, so central government brought an Act only for lottery Its name was the lotteries Regulation Act, 1998 - after it was introduced fair guidelines and transparency system with all the private and illegal ways of running lotteries were banned in India but even after this, the states made rules according to their own, so the system of lottery if we leave out 13 states, then in the entire India playing lottery is banned and among these 13 states there're many state governments which runs lottery themselves and even give money. And you cannot play lottery anywhere out of these 13 states.
So, Rummy, horse racing, lottery - you know their status, now comes fantasy and online gaming in the beginning of year 2000 the culture of online gaming was increasing rapidly, game of skill and game of chance already had a dispute in India, but after online gaming people who were betting money there wasn't any rule for it. So, more problems started and it all starts in 2001 when ESPN & Start Sports together bring a fantasy app, named - Super Selector but as 2003 arrives, they go into loss as its launch time wasn't that good. So you can make a team in it and when the live match is going on, you can play in it. The real life players, the sports person, that are in the actual sports. They are linked to your fantasy app players.
The type of performance the player has on the real life game, the same performance would be the fantasy app players. You will feel like, your own players are bowling and batting. But in reality, this is just a fantasy.
There are real life matches in it. Make your own team and as live players gather runs, your points will increase, if you've picked that player. The one with the most point wins.

Now the player, who won also payed 100 rupees, so if you remove it, then the winner's profit is 101. 6 rupees. So in this 500 rupees game, the player gets 101.
6 rupees. The fantasy app got 72 rupees. And the government, combining GST and TDS, they get 226.
4 rupees. The biggest profit is of the government. And this is not a small amount.
This goes in thousands of crores. According to Hindustan Times' report, on every international match of Indian cricket team, around 1500 crores rupees are given to these apps by people. .
On just one match. And combining domestic and international tournament matches, then its number bigger than 10 lakh crores. Talking about the 2022 revenue of fantasy apps, then its 6800 crores.
And this revenue will be 25,240 crore in 2027. There are multiple rooms in any one match, multiple games, even mutiple events. But if talking about one mega event, in which the winner becomes mega winner.
Roughly 1. 5 crore people participate in this. In which, entry fees is 49 rupees.
That is, 73. 5 crore rupees are gathered. In which, the government takes 33.
28 crore, 10. 58 crore goes to fantasy apps. And this is the amount of a small activity for a single match.
There are countless rooms like this. In one match, there are around 74 matches. 48 matches in world cup.
And talking about yearly, there are so many leagues, not just IPL or India, EPL, then hockey, football, there are matches in many places. And thousands of crores goes to government, state government and fantasy app. This fantasy app make celebrities and cricketers do ads.
So even they get money. They get different rights from BCCI, so even BCCI receives thousands of crore. So to say, BCCI is earning from this, state government is earning money from this.
Central government is earning from this, cricketers, celebrities are earning money from this. And if everyone is earning, then where is the money coming from ? This money is from you.
Your parent's hard work or your own. But ultimately, your own pocket will be empty. That's why you are explained 24/7 on TV, that I will do this, just make a team and leave everything else.
Ed tech companies, like Byju's and all are in loss. But these fantasy apps are becoming unicorn, earning thousands of crores, by making you dream of becoming a millionaire. And even if someone wins once or twice, then thousands of people think they can do that too because of them.
Mathematically, there's very less probability of someone winning on these apps. Even if I talk about the mega event, then there's a 0. 00000667% probability of you winning.
And someone's extra clever in this, because team is made for 49 rupees. So what they do is, buy two three teams, to increase their chances. But there's more loss to the ones who do that.
See, if you gather your friends, or school, college, village make 1 lakh team, even then your winning chances, mathematically are close to 0. Even if you gather more than 7 crore people, even then you won't win. Why am I saying this, I will explain.
Combining two teams in fantasy apps, you have to make a team of 11 people. That is, to choose 11 players from 22 players. If you calculate all the combinations, then the combinations are 705432.
And it doesn't end here, you have to choose captain and vice captain from this. Now, you made a team of 11 players, then there are 110 combinations of making only captain and vice captain. And if you multiply this 110 combination of captain and vice captain with 705432 then there will be 77597520 combinations.
You will have to make 7 crore teams, and even that won't be enough, because there's still a few factors less, if you replace captain and vice captain. See, even if you don't understand the calculation, just understand, which is the most important, you have more chances of becoming a Prime Minister of a small country, than becoming a millionaire from these apps. Excitement comes in a boring life. And then this thing converts into an addiction. This addiction is like that, the army men who are mentally so strong, even they are caught up in this.
You can go a small Google search, you will know how an army person's 20 lakh rupees have been gone. That's why when the addiction rises to a threshold, there's a need for treatment as well. In these fantasy apps, the winner thinks they are clever and puts money again and the loser puts money to gain back what he lost.
Plays again and again. This is a vicious cycle that never ends. Due to the lower price barrier, you get entry into the game by giving 10, 20 rupees.
That's why there are a lot of users on this. There are several cases in this, where kids younger than 18 used their parents Adhaar card to play. There's no procedure to confirm or stop this.
And there's also a referral system in this. Even if one kid in a group gets addicted to it, then they will try to give this referral and get other kids addicted to it. And the rest of the effort is completed by celebrities and cricketers.
See, an unknown man makes an app and asks money, people won't do it. But if the same man starts to run ads with celebrities which people pray, team captain, vice captain. Promote it using ads, then everyone would start joining it.
People consider them god, they have crores of fan, their promotion plays a very important role to quickly grow users in the app. There are 18 crore active users of these fantasy apps, that is, in any situation, these 18 crore will watch the match. And in 2027, these users will be 50 crores.
That's why it is suited by BCCI, IPL, their team owners and all the giants. They never want these fantasy apps to stop. These fantasy apps have so power that they give threats themselves.

They talk about making this fantasy ecosystem app to a trillion economy. There's foreign direct investment in the country due to them. America's Tiger Global, UK's Steadview management, they are investing thousands of crore in these fantasy apps.
And all of the money is coming in India. Even if government takes a step, then current investor will back out, along that the coming investors will stop. So there will be heavy loss due to this, that's why state and central government silent watches the show.
If we tweaked even a little of these fantasy app's revenue, their operations, then BCCI's revenue, state government's revenue, IPL's revenue, central government's revenue. The revenue of celebrities and cricketers, revenue of big businessmen, it would deeply impact all of them. That's the reason, even if regulation comes, but experts say that fantasy apps will never stop in India.
Even if the whole world goes against it. That's the reason, the old laws and acts are kept as it is, there have been no changes in them. And changes is a long talk, Lok Sabha, Rajya Sabha, forget bill, there hasn't even been any talks about it.
Sourav Ganguly who has been former president of BCCI, which was given the responsibility of bringing reform in cricket administration by the Supreme court. They are telling everyone to make teams in ********. Ironically become the brand ambassador.
There was a PIL filed in Madras High Court, in which apps like *******, the celebrities that endorse them like Sourav Ganguly, Virat Kohli, Tamannah Bhatia, an objection was raised on them. Madras High Court said, this app is getting popular due to the two former captains of India, Sourav Ganguly and Virat Kohli. And taking people's money.
Justice N. Kirubakaran and Justice B. Pogalendi, they said these celebrities promoting these apps, there should be an objection raised on them.
Even they should be considered in this. Justice Kirubakran said, Sourav Ganguly is a star, he is visible in ads and people become victims. If a cricket star, or celebrity promotes these apps, then what does it mean for a normal person?
They follow them. See these fantasy apps, one problem is about the addiction and loss of money. This is also a kind of disease.
And I will tell why I'm saying this. See the American Psychiatric Association, they publish DSM-5. Its full form is, Diagnostic and Statistical Manual of Mental Disorder.
Like that, WHO also publishes ICD-11. ICD means International Classification of Diseases. They publish a comprehensive list and criteria about diseases related to brain.
What's the disease, what should be done for that. And the doctors worldwide, read this and update their methods of treatment. These are very important tools for professionals all over the world.
So in this DSM-5 edition and ICD's 11 edition, these online and offline gaming addictions are compared to the diease related to substance. That is compared with alcohol and drugs. And made a category of their own.
There are treatments for pathological and disordered gambling. And medicines are also made for this. According to the report of Translational Psychiatry report, people who gamble too much, their part of the brain, which controls impulses, gets weak.
That is, they lose control over themselves. Its easier to fool someone who gambles. What you see in red is the area which gets weak.

On 10th of March, 2017, a man named Varun Gumber, transferred 50,000 rupees from this credit card and made a team on the fantasy app. In just 2 days he lost all his money. He files a case in Punjab and Haryana court, that these fantasy apps are gambling, its not a game of skill, it should be banned.
The case goes on for days. See, we discussed earlier, if the case goes in court, first it is checked whether it is a game of skill or game of chance. And even here, after multiple discussion, court says you select players based on their skills these fantasy apps.
You've seen the player's performance earlier as well. You can compare player to another player. Which pitch condition will suit which player, and which not.
You make a team by using your brain. So these fantasy apps are a game of skill. And Varun Gumber loses this case.
And from year 2017, fantasy apps get a legal framework that this is a legal game. See court takes decisions based on the law. Not emotions or what it personally thinks.
And when the law was made, these online games were not there. Law is the same old one. So even the court is not able to do much.
You can ask anyone, whether KBC is a game of skill or chance. Everyone will say, it is a game of skill. There will be no doubt about it.
But if KBC starts to gather crores of rupees from people, then takes their cut from it. And then for one question, 1 crore people tap the buzzer for the question. Press it and see which one gave the answer first.
The winner would be selected on the basis of that. So will KBC be a game of skill? Okay, if you assume these fantasy apps are a game of skill.
Then comparing a normal person, the cricketer who knows this game, why are they earning money by doing commentary after retiring. There would be no sureity that they would win. Even they would lose, because the chances are so low. Then how is this a game of skill.

But instead, a random person's name comes out that won. Who doesn't have any knowledge as apposed to a cricketer. And this happens because in this whole fantasy app, skill is not the dominating factor.
You might've heard, Sitamani who didn't even used to watch cricket, put money because of his friends and made a team. He won more than a crore rupees. Now he doesn't have more knowledge than a cricketer, but even then he won.
But the whole focus of these fantasy apps is to prove that our app is a game of skill. That's why you must've heard the line in their advertisement, "Play using brain". So that when they go to court, it will be a game of skill.
There are some states, who've had a very negative effect because of it. Many homes were destroyed. Many lost their lives.
And this was increasing so quickly, that those states, in October 2022, states like Assam, Andhra Pradesh, Odisha, Telangana, Nagaland, and Sikkim are there. They suddenly banned these apps, without even thinking twice, on October 2022. And some states had to geo layer.
That is, if you go in those state's boundary, then that app will stop working. But people were so addicted that they would cross the border, make a team and then come back. Kids have started proper black marketing.
In 2021, government employee named Keshav Ramesh, he saw some kids around his home playing Ludo. And when he checked, they were playing Ludo by giving money. And after seeing all this, he immediately complained in Girgaon police station.
After that he went to court, and fought a case. But it was the same, game of skill or chance. The discussion starts, and all the same things here.
The token cannot be forwarded without thinking. Which token to play when, this is also a skill. So Ludo was also considered a game of skill.
And even that became legal. Okay, these online apps have become legal but even after that the government doesn't regulate them. They are self regulated.
See, the government doesn't regulate every department, they put them in self regulation. They are self regulated. Like, TV, in case of that the broadcaster made an association called BARC.
They regulate their organisation themselves. Similarly, news media have made NBA. They self regulate themselves.
So in the case of these fantasy apps, government doesn't do any regulation. Fantasy app's themselves have made FIFS. They see themselves whether they are doing regulation properly or not.
That is, they are the ones protecting the milk. See, these fantasy apps are at least in limelight. Under government, they do regulation.
But some apps have also come in the market, that do proper illegal activity with the cover of fantasy apps. There's no one to oversee them. And these apps have caused so many kids and homes in problems.
You must've heard regularly that government banned so much apps that were taking people's money and deleted data. There was an app called Mahadev, it was the same with it. Actually, Bhilai in Chattisgarh, guy names Sourabh Chandrakar, who used to run a juice shop with the name Mahadev.
And at some distance there was a tyre shop where his friend, Ravi Uppal, run that shop. They used to gamble along with their work, gamble money. And due to that addication, they were in too much loan.
So the ones from whom they took money, were after them. So they went to Dubai, leaving India. There, they were doing small works and they meet a pakistani there.
Through a pakistani they reach a sheikh. And they give the sheikh idea of a gambling app called Mahadev. Sheikh puts money and they made an app called Mahadev book.
They made this app in Dubai but they put its operation in India. With this app, they gave franchise in India and used to run this app by indians. People would gamble money on cricket, cards, poker in their app, proper gambling.
In just a few days, this app quickly grew. They started to earn more than 200 crore in just a day. But the people were losing a lot of their money.
Their lives started to get destroyed. So when people lose, they complain to the police, file case in court and it happened just like that. When the cases become too much, ED tracked them and at that particular time, the owner of this app, Sourabh, he was getting married at the time.
He had a marriage of more than 200 crores. And even at the wedding they ordered private jet, called hero, heroine from India. And everyone was paid in cash.
From this, ED's investigation sped up. ED had a lot of operations, even politics was involved in this. According to ED, some people of Chattisgarh were also involved.
And there are allegations that Chattisgarh's CM, Bhupesh Bhagel, he took amount more than 500 crore from Mahadev app. And he did this work through his advisor Vinod Verma. So these allegations were placed.
And Bhupesh Bhagel obviously denied it. He said its politics at play, in fact he was one of the people who talked of getting Mahadev app banned. And he also said that he himself got it banned.
There's still case going on about this. So definitely keep away from these type of apps. And in May 2022, the government has come to action.
A committee has been issued. Which is studying it, and regulation will be there in the coming times. But only regulation, if you think that fantasy app will be banned, its very impossible.
